These terms and conditions apply to all web design and development services provided by Risa Medical, trading as NI Web Design ("we", "us", "our"), registered at 10 Rushy Road, Ballyclare, Northern Ireland.
1. Services Provided
NI Web Design provides custom website design and development services, including but not limited to WordPress website builds, e-commerce solutions, booking systems, payment integration, and ongoing website support and maintenance.
2. Quotations and Pricing
All quotations are valid for 30 days from the date of issue. Prices are quoted in pounds sterling (GBP) and are inclusive of VAT where applicable. Any work not included in the original quotation will be scoped and quoted separately before being carried out.
3. Payment Terms
- A deposit of 50% of the total project cost is required before any work begins.
- The remaining 50% is due upon project completion, before the website is launched or made live.
- Payments can be made via bank transfer or Stripe.
- Invoices are payable within 7 days of issue.
- Late payments may incur interest at 8% above the Bank of England base rate, in line with the Late Payment of Commercial Debts (Interest) Act 1998.
4. Project Timeline and Delivery
We will provide an estimated timeline at the start of every project. Timelines depend on the complexity of the work and the timely provision of content and feedback by the client. We will keep you informed of progress throughout the project.
Delays caused by the client (such as late provision of content, images, or feedback) may push back the delivery date. If a project is inactive for more than 30 days due to client delays, we reserve the right to reschedule or close the project.
5. Client Responsibilities
The client agrees to:
- Provide all necessary content (text, images, logos, branding assets) in a timely manner.
- Provide feedback on design drafts and development milestones within a reasonable timeframe (typically 5 working days).
- Ensure that all content supplied is accurate, lawful, and does not infringe any third-party rights.
- Provide access to any required third-party accounts (domain registrars, hosting, email providers) as needed.
6. Revisions
Each package includes a set number of revision rounds:
- Starter Package: 1 round of revisions
- Business Package: 2 rounds of revisions
- Premium Package: 3 rounds of revisions
A "round of revisions" means a single set of grouped feedback on a design or development milestone. Additional revisions beyond the included rounds will be charged at £50 per hour.
7. Intellectual Property
Upon receipt of full payment, the client owns the completed website, including all custom design work, code, and content created specifically for the project.
NI Web Design retains the right to showcase the completed website in our portfolio, case studies, and marketing materials unless otherwise agreed in writing.
Any pre-existing intellectual property (such as WordPress themes, plugins, stock images, or open-source libraries) remains the property of the respective owners and is subject to their own licensing terms.
8. Hosting and Ongoing Support
Hosting and ongoing website support are optional services, billed monthly or annually as agreed. These services are separate from the initial website build and will be quoted independently.
Either party may cancel ongoing support arrangements with 30 days' written notice.
9. Third-Party Services
Our websites may integrate with third-party services including but not limited to Stripe, WordPress plugins, Google Fonts, and Google Maps. NI Web Design is not responsible for changes, outages, or issues caused by third-party services.
Any costs associated with third-party services (such as Stripe transaction fees, premium plugin licences, or domain registration) are the responsibility of the client unless otherwise agreed.
10. Limitation of Liability
NI Web Design will carry out all work with reasonable care and skill. However:
- We are not liable for any loss of business, revenue, profits, or data arising from the use or inability to use the website.
- Our total liability for any claim is limited to the total amount paid by the client for the project in question.
- We are not liable for issues arising from client-made changes to the website after handover.
- We are not liable for the performance, security, or availability of third-party hosting providers chosen by the client.
11. Cancellation
Cancellation terms are covered by our Refund Policy. All cancellations must be made in writing via email.
12. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project. This obligation survives the termination of the agreement.
13. Governing Law
These terms are governed by the laws of Northern Ireland and the United Kingdom. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Northern Ireland.
